Mandatory hidden utility fees

Compulsory recurring charges beyond rent: amenity/community fees, valet trash, pest control, technology or smart-home packages, 'resident benefits package', utility administration and convenience fees, a landlord 'liability waiver program' at $10-15/month or insurer 'approved by landlord', plus 'all utilities, charges and outgoings' or ratio utility billing (RUBS) with an undisclosed formula, markup, common-area costs or owner-only levies (взнос на капремонт, налог на имущество, service charge).

Why it bites

Fees add tens to hundreds per month absent from the listing and surface at signing or first invoice (Greystar's fees cost renters hundreds of millions); the landlord earns commission on insurance that protects the landlord; undefined 'outgoings' and RUBS with no formula let anything be passed through, including prior tenants' arrears.

Is it enforceable where you are

The same clause can be routine in one country and void in another. What follows is what the law says where you are — not advice on your particular contract.

In the US, deposit deadlines and entry notice are set state by state; in England and Wales the Consumer Rights Act 2015 and the deposit protection schemes apply, and in the EU national tenancy law sits on top of Directive 93/13.

FTC Act s.5 deception: FTC/Colorado v. Greystar (complaint Jan 2025; $24M settlement announced 2 Dec 2025) and FTC v. Invitation Homes (Sept 2024, $48M) require all-in price disclosure; state laws (CO, MN, CA) increasingly mandate total-cost disclosure and ban some fees; RUBS must be disclosed with method in TX, CA, CO, MD, DC (DC AG alert May 2025); requiring renter's insurance is legal but forcing a specific insurer or charging 'verification fees' is targeted.

United Kingdom

Tenant Fees Act 2019 bans any payment other than rent, capped deposits, utilities/council tax and narrow default fees — 'admin', 'renewal', 'inventory' and insurance-related charges are prohibited payments; OFT/CMA: 'all existing and future charges and outgoings' and landlord-selected insurance terms are unfair; rental bidding illegal under the Renters' Rights Act 2025.

  2. Strike fees for unwanted services and 'benefits packages'
  3. Accept only a reasonable requirement to hold your own contents/liability cover from any insurer and delete auto-enrolment and 'verification' fees
  4. List exactly which utilities you pay and by what stated formula, excluding owner-only levies
  5. Ask for the last 12 months of bills
