Enforcement without a hearing
You pre-agree that the lender may obtain an enforceable judgment without a hearing (cognovit note), collect via an «исполнительная надпись нотариуса», seize collateral without court ('peaceful self-help'), track and disable the car via a GPS/starter-interrupt device, or take 'all household goods', future wages, deposits or the car title («заём под залог ПТС») as security for a sum far below the collateral's value.

Why it bites
You learn of the debt when bailiffs freeze your account, with no chance to contest amounts or penalties first; the car dies on the road (USASF disabled cars 7,500+ times wrongly) and a fire-sale deficiency follows you; lenders threaten to take furniture and phones; wage assignments bypass garnishment limits.
Is it enforceable where you are
The same clause can be routine in one country and void in another. What follows is what the law says where you are — not advice on your particular contract.
In the US, TILA/Regulation Z governs disclosure and the CFPB polices unfair practices; in the EU, the Consumer Credit Directive and Directive 93/13 apply, and the CJEU has repeatedly struck price and rate clauses that a borrower could not have understood.

FTC Credit Practices Rule 16 CFR 444.2 bans confession-of-judgment, waiver-of-exemption, non-purchase-money household-goods security and irrevocable wage-assignment clauses in consumer credit; self-help repossession allowed without breach of the peace (UCC 9-609); starter-interrupt devices lawful in most states with disclosure, wrongful disabling is UDAAP (CFPB v. USASF 2023); title loans banned or capped in about half the states.

European Union
Notarial enforceable deeds exist (PL, DE, ES, HU) but CJEU C-415/11 Aziz and C-32/14 ERSTE Bank Hungary require judicial review of unfairness before or during enforcement; repossession normally needs a court order; consumer credit mostly unsecured; remote disabling raises GDPR issues and is not market practice.

Russia
Исполнительная надпись lawful since 2016 (Основы законодательства о нотариате ст. 89-90, 360-ФЗ) if the agreement provides for it, with 14 days' notice before applying and a 10-day court challenge (ГПК ст. 310); non-judicial foreclosure on an individual's pledge requires a notarised agreement (ГК ст. 349), otherwise via court and ФССП; МФО may not take residential real estate as collateral (151-ФЗ ст. 12); car pledges should be registered; disabling devices not used for consumers.

What to do

- Strike the clause or choose another lender
- Limit security to the item purchased and refuse wage assignments
- Keep proof of every payment
- RU: file the court challenge within 10 days of learning of the inscription (ГПК ст. 310), check the pledge is registered in the реестр уведомлений о залоге and that seizure requires court/ФССП unless a notarised procedure was agreed
- US: report consumer confession-of-judgment, household-goods and wage-assignment clauses (banned by the FTC Credit Practices Rule)
- After repossession demand the sale accounting and dispute the deficiency.
