Demand full balance anytime

The lender may declare the entire balance due 'without notice' for any breach — one missed payment, a 'reasonable belief you are unable or unwilling to repay', a change of job or 'deteriorating finances' — and a default on any other obligation to the lender or its affiliates is a default here, while collateral pledged for this loan also secures every present and future debt (dragnet).

Why it bites

A small slip becomes the whole debt due at once, followed by collection, notary enforcement or repossession; vague triggers are judged solely by the lender; being 30 days late on a credit card lets a credit union repossess a car you are current on, and the title is not released until other debts are cleared.

Is it enforceable where you are

The same clause can be routine in one country and void in another. What follows is what the law says where you are — not advice on your particular contract.

In the US, TILA/Regulation Z governs disclosure and the CFPB polices unfair practices; in the EU, the Consumer Credit Directive and Directive 93/13 apply, and the CJEU has repeatedly struck price and rate clauses that a borrower could not have understood.

United States

Enforceable; UCC 1-309 requires a good-faith belief for 'insecurity' acceleration; cross-collateral is standard in credit-union agreements, but CFPB Supervisory Highlights (2022) found post-repossession use of such clauses to accelerate unrelated debts unfair (UDAAP); most states require notice before deficiency claims.

European Union

CJEU C-421/14 Banco Primus (2017) and C-70/17 Abanca (2019): acceleration for a single missed instalment can be unfair and must be proportionate; cross-default unfair if not transparent or disproportionate (93/13 Annex 1(e),(i)); national laws generally limit acceleration to defaults under the same agreement.

Russia

353-ФЗ ст. 14 ч. 2 — acceleration only after delinquency of more than 60 days within the last 180 (10 days for loans under 60 days), with 30-day notice; other triggers such as 'ухудшение финансового положения' held ущемляющими (ВАС РФ № 146) but still appear; cross-default with other loans conflicts with ст. 14; cross-collateral valid only if the залог agreement expressly covers the other obligations (ГК ст. 337).
