The lender reserves the right to change rates, fees, limits or 'any term' at any time, replace the reference index, reduce or cancel the credit line without notice, and amend 'General Conditions' by posting them on its website.

Why it bites

Your cost and available credit are never fixed; a variable APR has a floor but no cap; a surprise credit-line cut pushes you over-limit and triggers fees; changes published online bind you unread.

Is it enforceable where you are

The same clause can be routine in one country and void in another. What follows is what the law says where you are — not advice on your particular contract.

In the US, TILA/Regulation Z governs disclosure and the CFPB polices unfair practices; in the EU, the Consumer Credit Directive and Directive 93/13 apply, and the CJEU has repeatedly struck price and rate clauses that a borrower could not have understood.

United States

Generally enforceable; for credit cards Reg Z 1026.9(c) requires 45-day advance notice of significant changes and a right to reject; credit-line reductions and closures without notice are lawful.

European Union

Directive 93/13 Annex 1(j): unfair unless a valid reason is stated; financial-service providers may alter the rate for a valid reason with prompt notice and a right to terminate (Annex 2(b)); variation clauses must be transparent (CJEU Invitel C-472/10, RWE C-92/11).

Russia

Banned for increases: a bank may not unilaterally raise interest or fees, shorten the term or add obligations of an individual borrower (ст. 29 ФЗ о банках; 353-ФЗ ст. 5 ч. 16 permits only reductions); changes to Общие условия adding no obligations are allowed; card limits may be reduced; ВАС РФ № 146/2011 held unilateral rate-change clauses ущемляющими.
