Strict claim notice deadlines

Notice 'immediately' / 'within 24 hours', a police report within 24 hours, a sworn proof of loss within 60 days, specific third-party documents (справка Гидрометцентра, постановление МВД), treatment only after contacting the assistance line or in-network with prior authorisation and 'usual and customary' pricing, and a ban on settling or releasing the at-fault party — each a 'condition precedent' whose breach lets the insurer 'refuse' the claim.

Why it bites

People handle the emergency first and call later; documents from police or weather services take weeks; unapproved care is reimbursed at a fraction or not at all («расходы не согласованы с сервисной компанией»); a quick release signed with the other driver destroys the insurer's subrogation and your claim with it; insurers treat lateness as a complete defence even without prejudice.

Is it enforceable where you are

The same clause can be routine in one country and void in another. What follows is what the law says where you are — not advice on your particular contract.

In the UK, the Insurance Act 2015 and Consumer Insurance (Disclosure and Representations) Act 2012 restrict what an insurer may avoid; in the EU, the IDD and Directive 93/13 apply, and in the US, insurance is regulated state by state.

United States

Most states apply a notice-prejudice rule though a minority enforce strict deadlines; Florida SB 2-A (Dec 2022) sets a one-year notice window for property claims; NAIC Model 900 §4(K) treats duplicative proof-of-loss demands as unfair; prior authorisation and network rules lawful but the No Surprises Act (from 1 Jan 2022) bans surprise balance billing for emergency and certain out-of-network care; ERISA plans may enforce reimbursement over made-whole defences (US Airways v. McCutchen, 2013).

European Union

Germany VVG §28: post-loss duty breaches bite only if intentional/grossly negligent, proportionally and after a written warning; statutory subrogation (VVG §86) with a household privilege; national ombudsmen require payment where the consumer could not reasonably call first.

Insurance Act 2015 s.11 bars reliance on a risk-mitigation term where non-compliance could not have increased the risk of the actual loss; FOS expects the insurer to show prejudice and not to reject solely for failing to call the helpline; a 'condition precedent' label does not rescue unfair reliance under CRA 2015.

Russia

ст. 961 ГК — late notice allows refusal only if the insurer did not learn of the event otherwise and the lack of information could affect its obligation; п. 53 Пленума ВС № 19/2024 — no refusal for missing documents when the rest suffice; ОСАГО application within 5 working days (ст. 11 40-ФЗ) but delay is non-fatal absent prejudice; courts award emergency costs incurred without prior approval; ст. 965 ГК — subrogation passes on payment and waiving claims against the wrongdoer releases the insurer (п. 4).

  1. Notify in writing the same day (app, email, portal — keep the receipt), save the assistance number, log every call and authorisation number, and ask for the document list in writing
  2. Never sign releases with the at-fault party without the insurer's consent
